1. Introduction and Acceptance of Terms
Welcome to LYAM ("Left You A Message"). These Terms and Conditions ("Terms") govern your access to and use of the LYAM mobile application ("App"), available on iOS and Android, operated by LYAM (contact available on request) ("we," "us," or "our"), registered in Spain.
By downloading, installing, or using LYAM, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
These Terms constitute a legally binding agreement between you and LYAM. We recommend you read them carefully and keep a copy for your reference.
2. About LYAM
LYAM is a notification delivery service that allows users to compose and send short private text messages to recipients via email, whether or not the recipient has the LYAM app installed. LYAM acts solely as a conduit for message delivery — we do not generate, curate, moderate, or take editorial responsibility for the content of messages sent through the App.
LYAM is not a general social media platform. It is a personal messaging utility designed for private, individual use. The following features are available in the current version:
- Text message composition and delivery
- Delivery via email
- Encrypted message storage (at rest)
- In-app subscriptions (Solo and Annual plans)
- Apple Family Sharing (iOS) for shared subscription access
- Push notifications for message delivery alerts
Media and file sharing may be introduced in future versions and will be subject to updated Terms at that time.
3. Eligibility
To use LYAM, you must:
- Be at least 16 years of age (or 13 in jurisdictions where that is the applicable minimum, such as the United States).
- Have the legal capacity to enter into a binding agreement.
- Not be prohibited from using the App under the laws of your jurisdiction.
By using LYAM, you represent and warrant that you meet all of the above eligibility requirements. If you are between 13 and 16 years of age, you confirm that you have obtained verifiable parental or guardian consent to use the App.
We reserve the right to terminate or restrict access to any account where we reasonably believe the eligibility requirements have not been met.
4. Account Registration
LYAM uses anonymous authentication. You are not required to provide your real name, government-issued ID, or create a password to use the App. A unique anonymous identifier (UUID) is assigned to your account upon first use.
You are responsible for:
- Maintaining the security of your device and the LYAM app installed on it.
- All activity that occurs under your account.
- Ensuring that any contact information you provide belongs to you or that you have the recipient's consent to use it for message delivery.
You must not create accounts by automated means or under false pretences. Each person may hold only one active LYAM account at a time.
5. Acceptable Use Policy
LYAM is provided for lawful, personal communication only.
5.1 Prohibited Content
- Send, transmit, or store any content that is unlawful, defamatory, threatening, abusive, hateful, obscene, or otherwise objectionable.
- Harass, bully, intimidate, or abuse any individual.
- Impersonate any person or entity, or falsely represent your identity or affiliation.
- Infringe any third-party intellectual property rights, including copyright, trademark, or privacy rights.
5.2 Prohibited Conduct
- Send unsolicited or bulk messages (spam) to recipients who have not consented to receive them.
- Use LYAM for any commercial solicitation, advertising, or marketing without our prior written consent.
- Use automated scripts, bots, crawlers, or any non-human means to access or interact with the App.
- Attempt to gain unauthorised access to any part of the App, our servers, or any connected systems.
- Interfere with or disrupt the integrity or performance of the App or its infrastructure.
- Circumvent, disable, or otherwise interfere with any security or access control features of the App.
- Use LYAM to facilitate any illegal activity, including but not limited to fraud, money laundering, or distribution of illegal materials.
We do not actively monitor message content. However, we reserve the right to investigate and take action — including account suspension or termination — upon becoming aware of violations through complaints, legal process, or other means.
6. Message Content and Sender Responsibility
You, as the sender, are solely responsible for the content of any message you compose and send through LYAM. By sending a message through LYAM, you represent and warrant that:
- You have the right to send the message to the intended recipient.
- The content does not violate any applicable law or these Terms.
- You have obtained any necessary consents from recipients, including consent to receive messages via email.
LYAM shall not be liable for any claims, damages, or losses arising from message content created by users. You agree to indemnify and hold LYAM harmless from any third-party claims arising from your use of the App or the content of your messages.
7. Subscriptions and Billing
7.1 Available Plans
- Solo Plan (Monthly) — a monthly recurring subscription for individual use.
- Annual Plan — a discounted annual recurring subscription for individual use.
- Apple Family Sharing (iOS only) — allows eligible family members to access a shared subscription through Apple's Family Sharing feature.
7.2 Billing and Payment
All payments are processed exclusively by Apple (App Store) or Google (Google Play). LYAM does not directly collect, store, or process any payment card information. By purchasing a subscription, you agree to the payment terms of the relevant platform: Apple App Store · Google Play.
7.3 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings.
7.4 Refunds
All refund requests are handled directly by Apple or Google in accordance with their respective refund policies. LYAM does not process refunds directly.
EU and UK consumers: Under the EU Consumer Rights Directive, you may have a statutory right to withdraw from a digital purchase within 14 days. However, by commencing use of the LYAM subscription service, you acknowledge that performance has begun and you may waive this right in accordance with applicable law.
7.5 Apple Family Sharing
Apple Family Sharing allows an Apple subscription holder to share their LYAM subscription with up to five family members. LYAM is not a party to the Family Sharing arrangement between you and Apple. The primary subscriber is responsible for all charges associated with the shared subscription.
7.6 Free Trials and Promotional Pricing
We may offer free trials or introductory pricing from time to time. Unless cancelled before the trial period ends, your subscription will automatically convert to a paid plan at the standard rate.
8. Intellectual Property
8.1 Our Intellectual Property
LYAM and all associated content, branding, software, design, and technology are the intellectual property of LYAM and are protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, or reverse engineer any part of the App.
8.2 Your Content
You retain full ownership of the messages and content you compose and send through LYAM. By using the App, you do not grant LYAM any licence to use, reproduce, or exploit your message content. We do not access or exploit your message content and claim no rights over it.
9. Account Suspension and Termination
9.1 Termination by You
You may delete your LYAM account at any time through the App. Upon deletion, all personal data associated with your account will be permanently and irreversibly deleted. Deleting your account does not automatically cancel an active subscription — you must cancel separately through your Apple ID or Google Play account settings.
9.2 Termination or Suspension by LYAM
We reserve the right to suspend, restrict, or permanently terminate your access to LYAM at our sole discretion if we reasonably believe that you have violated these Terms, your use poses a risk to others, we are required to do so by law, or your account has been inactive for an extended period.
9.3 Effect of Termination
Upon termination, your licence to use the App ends immediately, any outstanding messages may not be delivered, and your data will be deleted in accordance with our Privacy Policy. Termination does not entitle you to a refund of any prepaid subscription fees, except as required by applicable law.
10. Disclaimers and Limitation of Liability
10.1 Service Provided As-Is
LYAM is provided on an "as-is" and "as-available" basis without any warranty of any kind. To the fullest extent permitted by applicable law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and any guarantee that the App will be uninterrupted, error-free, or that messages will be delivered successfully.
We are a solo-operated service and do not offer any service level agreement (SLA) or uptime commitment.
10.2 Limitation of Liability
To the maximum extent permitted by applicable law, LYAM shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Where liability cannot be fully excluded by law, our total aggregate liability shall not exceed the greater of: (a) the total subscription fees paid by you in the twelve months preceding the claim, or (b) EUR 50.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable Spanish or EU law.
11. Indemnification
You agree to indemnify, defend, and hold harmless LYAM and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the App, any message content you compose or send, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
12. Third-Party Services
LYAM integrates with third-party service providers including Supabase (database), Resend (email delivery), RevenueCat (subscription management), and Firebase Crashlytics (crash reporting). These third-party services are governed by their own terms and privacy policies. By using LYAM, you acknowledge that your data may be processed by these providers as described in our Privacy Policy.
13. Privacy
Your use of LYAM is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your data as described in the Privacy Policy.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.
14.2 EU Consumer Rights
If you are a consumer resident in the European Union, you benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory local law provisions. EU consumers may also use the European Commission's Online Dispute Resolution platform.
14.3 Dispute Resolution
In the event of a dispute, we encourage you to contact us first at supportatlyam@gmail.com to seek an informal resolution. We will make reasonable efforts to resolve disputes amicably within 30 days of receiving written notice.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date," notify you via an in-app notification where practicable, and where required by law seek your renewed consent. Your continued use of LYAM after updated Terms have been posted constitutes your acceptance of the revised Terms.
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and LYAM regarding your use of the App and supersede all prior agreements, representations, and understandings.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of LYAM.
16.4 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity in the event of a merger, acquisition, or sale of assets, with notice to you.
16.5 Language
These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall prevail, except where local law requires otherwise.
